1. About these terms

These terms govern your use of this website and, where stated, the services provided by American Earth Haulers LLC ("we", "us", "our"). By using the site you accept these terms.

2. Information on this site

Information about materials, services, coverage and availability is provided for general guidance. Material availability, delivery coverage, storage capacity and truck availability vary by location and change over time. Nothing on this site is an offer capable of acceptance or a guarantee that a particular material or service can be supplied in your area.

3. Quotes and pricing

We do not publish fixed prices. Prices are quoted per project, based on the information you provide about material, volume, location, access and timing.

A quote is an estimate based on the details supplied and is valid for the period stated on it.
If site conditions, volumes or access differ materially from what was described, the price may change. We will tell you before proceeding.
A quote becomes binding only when confirmed in writing by both parties.

4. Deliveries

Delivery windows are agreed in advance and we work to meet them, but they are not guaranteed against weather, traffic, site conditions or events outside our control.
You are responsible for ensuring safe, legal and adequate access to the delivery point, and for confirming that the ground can take a loaded truck.
You are responsible for obtaining any permits, permissions or road closures required at the delivery location.
We are not liable for damage to driveways, surfaces, verges, utilities or underground services where we have followed your directions on access and drop point.

5. Materials

Earth materials are natural products. Color, texture, moisture content and composition vary between loads and between seasons.
Where a material is supplied to a stated specification, that specification governs. Otherwise material is supplied as a general grade of the type described.
You are responsible for confirming that the material selected is suitable for its intended use, including any engineering or compaction requirements.

6. Storage

Storage is subject to available capacity and to the material being of a type we are permitted to accept.
You confirm that any material delivered to us for storage is not contaminated and does not contain hazardous waste, and you remain responsible for its origin and content.
Storage terms, duration and charges are agreed for each arrangement.

7. Truck rental

Truck availability is confirmed per booking and depends on existing commitments.
Rental terms, including duration, permitted use, operator arrangements, insurance and condition on return, are set out in the rental agreement for each booking.
Equipment must be used lawfully, within its rated capacity, and only for the purposes agreed.

8. Cancellations

Cancellation terms are set out in the quote or agreement for the work. Where a truck has been dispatched or material loaded, charges may apply.

9. Payment

Payment terms are stated on the quote or invoice. We may charge interest on overdue amounts at the maximum rate permitted by applicable law.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any service is limited to the amount paid for that service. We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of contract or project delay costs. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.

11. Website use

Content on this site, including text, layout and design, belongs to us or our licensors. Photography is licensed from third party stock providers.
You may not copy, reproduce or republish site content for commercial purposes without permission.
You may not attempt to gain unauthorized access to the site, submit automated form submissions, or use the site in any way that damages or disrupts it.

Where this site links to third party sites, we are not responsible for their content or their practices.

13. Governing law

These terms are governed by the laws of the state in which American Earth Haulers LLC is established, without regard to conflict of law rules. The courts of that state have exclusive jurisdiction.

We may update these terms. The revision date at the top of this page shows when they last changed. The version in force at the time of your order applies to that order.
